Welcome to NutriSnap. These Terms of Service ("Terms") govern your access to and use of the NutriSnap mobile application, website, and related services (collectively, the "Service") operated by Quadkeys Technologies ("we," "our," or "us"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By accessing or using NutriSnap, you confirm that you are at least 13 years old (or 16 in the European Economic Area) and that you agree to comply with and be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Account Registration

• You must provide accurate, complete, and current information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You must notify us immediately if you suspect unauthorized access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms or remain inactive for an extended period.
• You may delete your account at any time through the app settings or by contacting us at support@nutritionsnap.com.

3. Subscriptions and Payments

• Free Tier: NutriSnap offers a free tier with limited features, including one food scan per day and basic calorie tracking.
• Premium Plans: Paid subscriptions (Premium monthly at $4.99/mo and Annual at $29.99/yr) unlock unlimited scans, AI coaching, weekly meal plans, and other premium features.
• Billing: Subscriptions are billed through the Apple App Store or Google Play Store. Payment is charged to your store account at confirmation of purchase.
• Auto-Renewal: Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your device's app store settings.
• Refunds: Refund requests are handled by Apple or Google according to their respective refund policies. We do not process refunds directly.
• Price Changes: We may adjust subscription pricing. Existing subscribers will receive notice before price changes take effect on their next renewal.

4. Credits System

• NutriSnap uses a virtual credits system. Credits are required for certain features such as food scans, AI coach interactions, and diet plan generation.
• Credits can be earned through daily login streaks, watching rewarded video ads, referring friends, and as part of subscription benefits.
• Credits have no monetary value and cannot be exchanged for cash, transferred to other users, or refunded.
• We reserve the right to modify credit earning rates, costs, and expiration policies at any time with reasonable notice.
• Unused credits may expire if your account is inactive for 12 consecutive months.

5. AI-Generated Content Disclaimer

NutriSnap uses artificial intelligence (powered by Anthropic Claude) to provide food recognition, calorie estimates, nutrition analysis, diet plans, and coaching responses. You acknowledge and agree that:

• AI-generated nutrition data (calories, macros, portion sizes) are estimates only and may not be 100% accurate.
• AI-generated diet plans and coaching responses are for informational purposes only and do not constitute professional dietary, nutritional, or medical advice.
• You should verify critical nutrition information independently, especially if you have food allergies, intolerances, or medical conditions.
• We do not guarantee the accuracy, completeness, or reliability of any AI-generated content.

6. Medical Disclaimer

NutriSnap is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

• The Service does not provide medical advice. Always consult a qualified healthcare professional or registered dietitian before making significant changes to your diet, especially if you have pre-existing health conditions, are pregnant, or are taking medication.
• Do not disregard professional medical advice or delay seeking it because of information provided by the Service.
• If you experience any adverse health effects, discontinue use and consult a healthcare provider immediately.
• Calorie and nutrition targets provided by the app are general guidelines and may not be suitable for your specific medical situation.

7. User Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to reverse-engineer, decompile, or extract source code from the application.
• Circumvent, disable, or interfere with security features or usage limitations.
• Use automated scripts, bots, or scrapers to access the Service or exploit the credits system.
• Upload malicious content, spam, or content that infringes on others' rights.
• Impersonate any person or entity, or misrepresent your affiliation.
• Share your account credentials with others or create multiple accounts to abuse free-tier limits.

8. Intellectual Property

• The NutriSnap name, logo, design, code, AI models, and all associated content are the intellectual property of Quadkeys Technologies and are protected by applicable copyright, trademark, and other intellectual property laws.
• You retain ownership of the photos and content you upload. By uploading content, you grant us a limited, non-exclusive license to process, store, and display that content as necessary to provide the Service.
• You may not copy, modify, distribute, or create derivative works based on any part of the Service without our prior written consent.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
• In no event shall Quadkeys Technologies, its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from your use of the Service.
• Our total aggregate liability for any claims related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Quadkeys Technologies and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

• You may stop using the Service and delete your account at any time.
• We may suspend or terminate your access to the Service at our sole discretion, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable.
• Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) will remain in effect.
• If your account is terminated for violation of these Terms, any remaining credits or subscription time is forfeited.

12. Governing Law and Dispute Resolution

• These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Quadkeys Technologies is registered, without regard to conflict of law principles.
• Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation.
• If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration body in our jurisdiction, unless you are located in a jurisdiction that grants you the right to bring claims in court.
• Nothing in these Terms limits your rights under mandatory consumer protection laws in your jurisdiction.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and notify you through in-app notifications or email. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
